These Terms and Conditions ("Campaign Terms") govern the CobWeb Pay Card Welcome Pack marketing campaign ("Campaign") provided by CloudTechX Pty Ltd (ABN 34 659 353 796) ("CTX", "we", "us", "our").
1. The Promoter
The promoter of this Campaign is CloudTechX Pty Ltd (ABN 34 659 353 796). The Campaign is a separate promotional program run by CTX and is not a feature of the CobWeb Pay Card, which is issued by EML Payment Solutions Limited ABN 30 131 436 532 AFSL 404131. EML has no involvement in this Campaign and is not responsible for its operation or the provision of rewards.
2. Binding Agreement
By participating in this Campaign, you agree to be bound by these Campaign Terms and our general Terms and Conditions available on our website. We reserve the right to disqualify any participant who breaches these terms.
3. Campaign Period
The Campaign commences on 18 November 2025 and ends on 30 June 2026 ("Campaign Period"), unless withdrawn earlier by CTX at its sole discretion. All qualifying activities must occur within this period.
4. Eligibility
To be eligible, you must:
• Be a natural person and an Australian resident.
• Be at least 18 years old.
• Be a new CobWeb Pay Cardholder who activates their first-ever CobWeb Pay Card during the Campaign Period.
• Have successfully completed our KYC (Know Your Customer) verification process.
• Not be an employee of CTX, EML, or their immediate families.
5. Campaign Mechanics & Rewards
5.1. New User Welcome Pack (First Calendar Month Post-Activation)
• Cashback Rate: CTX will provide a 4% cashback on the AUD value of all Eligible Purchases.
• Total Cashback Cap: The total cashback provided by CTX from all card transactions (including the 100% subscription cashback) is capped at 75.00 AUD in your first calendar month.
5.2. Existing User Benefits (From Second Calendar Month Onward)
• Standard Cashback Rate: CTX will provide a 2.5% cashback on the AUD value of all Eligible Purchases.
• Standard Cashback Cap: The total cashback provided by CTX is capped at 30.00 AUD per calendar month.
• Utility Bill Cashback: A 10% cashback is provided on utility bill payments (e.g., electricity, gas, water). This cashback counts toward the standard 30.00 AUD monthly cap.
• Spend & Earn Bonus: If you spend a minimum of $2,500 AUD on Eligible Purchases in a calendar month, your personal cashback cap for the following calendar month will be increased to 75.00 AUD. The standard 2.5% cashback rate applies.
5.3. Referral Program
• Standard Referral: You will receive 10.00 USDT for each unique new user you refer who (i) uses your referral code, (ii) successfully completes KYC, and (iii) uses the CobWeb Pay exchange function or does at least one transaction with the CobWeb Pay card.
• Tier Bonus: An additional bonus of 100.00 USDT is awarded for every batch of 25 successful referrals in a single calendar month. This bonus is capped at 100.00 USDT per calendar month.
6. Definitions
• "Eligible Purchases" means Mastercard purchase transactions that have been fully settled. It excludes ATM withdrawals, cash advances, balance transfers, fees, charges, refunded transactions, and transactions classified under excluded merchant category codes (MCCs) such as gambling, government services, and financial institutions. A full list is available on request.
• "Calendar Month" means the period from the first day to the last day of a calendar month, based on AEST.
• "Hard Cap" means the absolute maximum reward CTX will provide for the specified period. Once this limit is reached, no further rewards will be accrued or paid for that period.
7. General Terms
• Reward Payment: Cashback rewards will be credited by CTX to your CobWeb Pay exchange account within 14 days after the end of the calendar month in which they were earned. USDT referral rewards will be credited within 14 days of your referred friend activating their card.
• Separate Promotion: This Campaign is a discretionary promotional offer provided by CTX. It is not a feature of the CobWeb Pay Card, forms no part of your cardholder agreement with EML, and may be withdrawn or varied at any time at CTX's sole discretion.
• Tax Implications: You are solely responsible for any tax implications arising from your receipt of rewards under this Campaign.
• No Cash Alternative: Rewards are non-transferable, non-negotiable, and cannot be redeemed for cash.
• Variation and Termination: CTX reserves the right to vary, suspend, or terminate this Campaign or these Terms at any time without liability. In the event of termination, rewards earned up to the date of termination will be honoured.
8. Dispute Resolution and Complaints
8.1. Complaints regarding this Campaign
If you have a complaint about the operation of this Campaign or the provision of rewards, please follow this process:
1. Contact Us First: Email our customer service team at customerservice@cobwebpay.com with "Campaign Dispute" in the subject line. Please include your full name, registered email, and a detailed description of your complaint.
2. Internal Resolution: We will acknowledge your complaint within 2 business days and aim to provide a final response within 30 calendar days.
3. External Resolution: If you are not satisfied with our final response, you may refer your complaint to the Australian Financial Complaints Authority (AFCA). Please note that AFCA's jurisdiction may be limited as this is a promotion and not a core financial product feature. We will provide details of any applicable external scheme in our final response.
8.2. Complaints regarding the CobWeb Pay Card
Complaints about the card itself (e.g., transactions, fees, card issuance) are separate and are governed by the complaints process detailed in the Product Disclosure Statement (PDS) issued by EML Payment Solutions Limited.
9. Limitation of Liability
To the maximum extent permitted by law, CTX (including its officers, employees, and agents) excludes all liability for any loss (including any direct, indirect, or consequential loss) or damage, however caused (including through negligence), suffered by you in connection with this Campaign or your use of the rewards.
10. Privacy
Any personal information collected by CTX in connection with this Campaign will be handled in accordance with our Privacy Policy.
